Terms and Conditions
1. Acceptance of Terms
By accessing or using the private chef and luxury catering services provided by Edward Smith (referred to herein as "the Chef," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all the terms and conditions of this agreement, then you may not access our services.
2. Service Agreement
All private chef and catering services are subject to a formal written proposal and service agreement, which will outline the specific menu, date, time, location, number of guests, services included, and total cost. No service is confirmed until this agreement is signed by both parties and the initial deposit is received.
3. Booking and Payment
A non-refundable deposit, typically 50% of the estimated total cost, is required at the time of booking to secure your desired date. The remaining balance is due 7 days before the scheduled event. For bookings made within 14 days of the event, full payment may be required upfront. We accept payments via bank transfer, major credit cards, or other methods as agreed upon in the service agreement. Late payments may incur additional charges.
4. Cancellations and Refunds
- Client Initiated Cancellations: If you cancel your booking, the non-refundable deposit will be retained. If cancellation occurs within 14 days of the event, 75% of the total agreed-upon cost will be charged. Cancellations within 48 hours of the event may result in the full agreed-upon cost being charged.
- Chef Initiated Cancellations: In the rare event the Chef must cancel due to unforeseen circumstances (e.g., illness, emergency), all payments made will be fully refunded, or an alternative date will be offered. The Chef is not liable for any additional costs incurred by the Client due to cancellation.
5. Menu and Dietary Requirements
Menus are designed in consultation with the Client. All dietary restrictions, allergies, and preferences must be communicated clearly and in writing at least 7 days prior to the event. While we take utmost care to accommodate requests, we cannot guarantee a 100% allergen-free environment due to the nature of food preparation.
6. Client Responsibilities
The Client agrees to provide a safe, clean, and adequate working environment, including access to kitchen facilities, utilities, and necessary equipment as discussed. The Client is responsible for ensuring guests behave appropriately and for any damage to the Chef's equipment or property caused by guests.
7. Photography and Marketing
The Chef reserves the right to take photographs of the food and setup for marketing purposes, unless expressly requested otherwise by the Client in writing prior to the event. Guest likeness will not be captured without explicit consent.
8. Limitation of Liability
The Chef's liability for any claim arising from the services provided shall be limited to the amount paid by the Client for the service. The Chef will not be liable for any indirect, incidental, or consequential damages.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, USA.
10. Amendments
Edward Smith reserves the right to update or modify these Terms and Conditions at any time without prior notice. The latest version will always be posted on our website.
